66-7-340. Pedestrians soliciting rides or business.
A. No person shall stand in a roadway * for the purpose of soliciting a ride, employment or business from the occupant of any vehicle. *66-1-4.15. Definitions. (2007)N. “roadway” means that portion of a street or highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder
As with most states, the definition of roadway in this context in New Mexico permits the solicitation of rides when not on the traveled portion such as the shoulder or berm.
