27-51-1205. Soliciting rides.
No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any private vehicle.

Roadway in Because the definitions section of each police officer's book states that definition does not explicitly mention the shoulder, it is exclusive of probably best to hitch from the grass and not on the shoulder or berm. Like most states, if you are off the paved portion of the road, you are not considered to be in a roadway.
