No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any private vehicle.
The definition of roadway in this context may be open to interpretation by the police because it is not specifically defined in the same section27-49-212. Roadways.In all sections (b) “Roadway” means that portion of the vehicle code where roadway is defineda highway improved, it is defined as "that part of the road designed , or ordinarily used for the ordinary flow of trafficvehicular travel."
Because the definition does not explicitly mention the shoulder, it is probably best to hitch from the grass and not on the shoulder of the road.
